Squatting Law

The problem of “Squatting” in real estate has grown quickly over the last several years.

Squatting refers to illegitimate tenants moving in to uninhabited homes and living there without a lease. These illegitimate tenants do not make lease payments or maintain the property. In many cases the property is damaged and in need of expensive repairs.

Disputes between squatters and landlords often become lengthy legal battles, with homeowners trying to reclaim their property and squatters exercising their rights to stay.

Florida just passed House Bill 621, eliminating squatters rights.

Under the law, a property owner can request law enforcement to immediately remove a squatter if the person has unlawfully entered, has refused to leave after being told by the homeowner to do so, and is not a current or former tenant in a legal dispute.

Do you agree with HB 621 which supports the rights of property owners over the rights of the squatters?
